Contest Official Rules

 

NO PURCHASE OR PAYMENT NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

 

BY ENTERING THE CONTEST, EACH ENTRANT AGREES TO THESE OFFICIAL RULES.

 

  1. Eligibility: The New 98.9 The Bull Watershed Cornhole Tournament Contest (the “Contest”) is open only to listeners 21 years or older and residents of the state of Washington and Oregon who have tickets to the Watershed Festival at The Gorge Amphitheater August 2, 2019 – August 4, 2019 (the “Festival”) as of the day the entrant signs up to participate (each, an “Eligible Entrant”). Void where prohibited by law. No purchase necessary to enter the Contest. Employees of Hubbard Radio Seattle, LLC and its station The New 98.9 The Bull, 3650 131st Avenue SE, Suite #550, Bellevue, WA 98006 (the “Sponsor”), or any of their respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Contest (collectively with Sponsor, the “Released Parties”), any radio, television or other media companies located in the Seattle area, and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members of each such employee are not eligible to enter or win.  The Contest is subject to all applicable federal, state and local laws and regulations.  Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest.  Winning a prize is contingent upon fulfilling all requirements set forth herein.

 

  1. Contest Period: You can sign up online at 989thebull.com to compete in the Contest beginning on July 22, 2019 at 12:00:00 AM Pacific Time (“PT”) and ending at 11:59:59 PM PT on July 31, 2019 (“Online Sign-Up Period”); or you can sign up at the Watershed festival in person beginning on August 2, 2019 and ending at 12:00:00 PM PT (noon) on August 3, 2019 (“Event Sign-Up Period”). Then, the Competition begins at 3:00:00 PM PT and ends at 7:00:00 PM PT on August 3, 2019 (“Competition Period”).

 

  1. How to Qualify to become a Contestant: There are two ways to register for a chance to become a team member as a contestant in the Competition:  (1) Online Registration:  To register online for a chance to compete, Eligible Entrants can visit 989thebull.com during the Online Sign-Up Period, find the Contest mention, and complete and submit the online entry form for one (1) entry into the Online Random Drawing, where eight (8) Teams (defined below) will be randomly selected to participate in the Competition; or (2) Event Registration: To register at the Event for a chance to compete, during the Event Sign-Up Period, find The New 98.9 The Bull booth at the Festival (“Booth”) and be one of the first eight (8) Teams to sign up to participate in the Competition will be eligible to complete, on a first come, first served basis.

 

Regardless of the method of registering/signing up to participate in the Competition, each person signing up to participate can either sign up along with another eligible individual who will be deemed that person’s teammate, or the person signing up may choose to have Sponsor select his/her teammate for them (each, a “Team”).  Each Team will be made up of two (2) individuals. There will be a total of sixteen (16) Teams (8 from the Online Registration and 8 from the Event Registration) (for a total of 32 individual participants) chosen to participate in the Competition. Sponsor reserves the right to select fewer than 16 Teams in the event not enough sufficient Eligible Entrants sign up to participate.

 

  1. Online Random Drawing: On or about August 1, 2019, Sponsor will randomly select eight (8) Teams to participate in the Competition during the Competition Period from among all eligible entries received during the Online Sign-Up Period. Sponsor will notify each Team member on or about the day of the random drawing. Sponsor will make up to two (2) attempts to reach each potential Team member, and in the event Sponsor is unable to verify any Team member after two (2) attempts, that Team member forfeits his/her right to participate in the Competition, and an alternate Team member will be randomly selected from among all remaining entries, time permitting.

 

  1. How to Participate in the Competition: To participate in the Competition, each Team must find the Booth and check-in and sign a liability and publicity release no later than the specific deadline provided to each Team as designated by Sponsor when the Team was created (“Deadline”). Any Team who attempts to check in after the Deadline will not be eligible to compete in the Competition. Must be a Qualifier to become a Contestant and participate in the Competition.  No substitutions or stand-ins allowed without Sponsor’s prior approval.  After 16 Teams have signed up to participate, each Team will be randomly paired against another Team to compete in a bracket-style, single elimination cornhole competition (“Competition”).

 

  1. CORNHOLE COMPETITION RULES.

 

-Boards are placed 27 feet apart edge to front edge

-Games are played to 21 points. The first Team to reach 21 points in a game is the winning Team, and that Team will move on to the next Round. The winning team in Round 4 will be deemed the Grand Prize winning Team. The Team not reaching 21 in a game is the losing Team, is eliminated and not eligible to move on to any other Round.

-How points are calculated:

–  Woody: refers to any cornhole bag that has been pitched and remains on the cornhole board playing surface at the conclusion of the frame. Each Woody is worth 1 point.

–  Cornhole:  refers to any cornhole bag that has been pitched and passes through the cornhole board hole at any time within the frame. Each cornhole is worth 3 points.

-A bag that comes to rest touching the ground AND the board does NOT count as a point.

-Cancellation Scoring – the approved method of scoring for the sport of cornhole is “cancellation” scoring. In cancellation scoring, the points of one player cancel out the points of their opponent. Using this method, only one player/Team can score in each frame.

-Both players on each Team play one board at a time, and must stay in their designated lane for the entire game (right or left side of the board).

-Players start the game at board 1, and alternate pitching bags until each player has pitched all four of his/her bags.

-Players then walk to the end of their lane to the other board, take score and resume pitching back to the other cornhole board.

-Players must deliver the bag with an underhand release.

-Feet must stay behind the line of the front of the board at the time of releasing the bag.

-The player/Team who scored in the preceding frame pitches first in the enxt frame. If neither player/Team scores, the player/Team who pitched first in the preceding frame shall retain first pitch in the next frame.

-If bags become piled inside the cornhole board hole and may interfere or obstruct with the next pitch or if there is question whether a cornhole bag would have naturally fallen through the hole, a player may request to “rake” the cornhole bags that have fallen inside the hole.

-Sponsor shall be the sole judge and have final ruling authority over any disputes during the Competition.

-There will be 4 Rounds played during the entire Competition Period:

Round 1:  16 Teams

Round 2:  8 Teams

Round 3:  4 Teams

Round 4 (Final Round):  2 Teams

 

  1. Prizes and Approximate Retail Values (“ARV’s”) – One (1) Grand Prize – Meet & Greet passes to a Sponsor-specified artist during the Festival for each person on the winning Team. ARV: $275.00

 

Prize consists of only those items specifically listed as part of the Prize. Sponsor is not responsible for any postponed, cancelled or rescheduled meet and greet. No substitution allowed by winners, but Sponsor may substitute the prize, or any portion thereof, for a prize of equal or greater value at Sponsor’s sole discretion for any reason. All local, state, and federal taxes on the Prize are Winner’s sole responsibility.

 

The winners must meet the eligibility requirements as set forth in Paragraph 1 of these Official Rules. Winners are responsible for paying all applicable income taxes associated with accepting their Prize. Winners will be required to sign a liability and/or publicity release (“Prize Release”) prior to issuance of a prize. A 1099 form will be submitted to all appropriate taxing authorities for the Grand Prize.

 

  1. Claiming the Prizes: The potential Grand Prize winners must prove each is a qualified winner by presenting acceptable identification (g., state driver’s license; state issued identification card; valid passport with address verification; or birth certificate with social security card and photo identification and address verification) upon winning Round 4 of the Competition. If either of the winners are not able to prove he or she is a qualified winner, they will not receive their Grand Prize.  All unclaimed prizes remain the property of Sponsor.

 

  1. Participation Conditions/Release/Consent to use Likeness: By participating, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor which are binding and final in all matters relating to this Contest; (b) release and hold harmless the Released Parties from and against any and all claims, expenses, and liability, including, but not limited to, negligence and damages of any kind to persons and property, including, but not limited to, invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s participation in this Contest, and acceptance or use or misuse of prize; (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorney’s fees) arising out of or relating to an entrant’s participation in the Contest and/or entrant’s acceptance, use or misuse of prize; and (d) allow Sponsor’s use for promotional purposes of his/her likeness, voice and/or address (city/state) without any additional compensation. By calling in to participate in this Contest, each participant consents to his or her voice and telephone conversation being recorded and/or broadcast.

 

  1. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, for any reason whatsoever, including, without limitation, fire, flood, natural or man-made epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction or if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the participation process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Only the type and quantity of prizes described in these Official Rules will be awarded.  The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.  Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

 

  1. Limitations of Liability: The Released Parties as set forth above are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited, to malfunctions, interruptions or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the participation process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of phone calls; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any Prize.

 

  1. Privacy Policies and Data Collection: Information provided by you for this Contest on the entry form is subject to Sponsor’s privacy policy located at: http://corporate.hubbardradio.com/privacy-policy/. By entering this Contest, each entrant agrees that the Sponsor has the right to contact the entrant by phone, direct message, or email accounts provided on the entry form to administer and fulfill this Contest.

 

  1. Disputes/Governing Law: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or the prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state court of Washington; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ or legal fees; and (3) unless otherwise prohibited, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with this Contest shall be governed by, and construed in accordance with, the laws of the State of Washington, without giving effect to any choice of law or conflict of law rules (whether of State of Washington, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Washington.
